OFFICIAL GIVEAWAY RULES

1. Sponsor.
The Mountaintop Luxury Getaway Giveaway (“Promotion”) is sponsored by 1527408 B.C. LTD. DBA The Mountaintop Off-Grid Resort & Spa, located at 2619 Nicholson Creek Road, Rock Creek, BC, V0H 1Y0 (“Sponsor”). This Promotion is not sponsored, endorsed, or administered by, or associated with, Meta Platforms Inc., Facebook, or Instagram.


2. Eligibility.
Open to legal residents of Canada (including Québec) and the United States who are eighteen (18) years of age or older at the time of entry. Employees, officers, directors, representatives, and agents of the Sponsor and their immediate family members or those living in the same household are not eligible. Void where prohibited by law.


3. Promotion Period.
The Promotion begins at November 7, 2025 @ 8am PST and ends at December 3rd, 2025 @ 11:59pm PST (“Promotion Period”). Entries submitted before or after the Promotion Period will not be accepted.


4. How to Enter.
No purchase necessary. During the Promotion Period, participants may enter using any one of the following methods (limit one base entry per person total):

- Instagram: Follow @mountaintoprockcreek on Instagram and comment on the official giveaway post tagging two friends to receive one (1) entry. You may earn up to twenty (20) additional entries by tagging up to twenty (20) more unique friends in additional comments. Maximum twenty (20) entries per person on Instagram.

- Meta Lead Form: Submit your email address through the official sponsored ad lead form.

- Website: Submit your email address on the official entry page at https://stay.mountaintopbc.com/enter

​- Existing Subscriber Click-Through: If you already subscribe to one of our email lists, you may enter the giveaway by clicking the unique entry link provided in our promotional emails. No additional email submission is required. (Limit one base entry per person.)

Referral Bonus: After entering by any method, you may earn one (1) additional entry for each friend who enters through your unique referral link, up to five hundred (500) additional entries.

Duplicate base entries by the same person (e.g., via multiple methods) will be consolidated to one base entry. Any automated, bulk, or suspicious entries will be disqualified. Sponsor’s database clock is the official timekeeper for the Promotion.


5. Prize.
One (1) winner will receive a 3-night stay for up to four (4) people at The Mountaintop Resort in Rock Creek, BC, including:

- Private helicopter charter for 4 from Kelowna, BC to the property (return transportation provided by Sponsor by vehicle);

- 7-course chef-made dinner for 4 guests prepared by Row 14 (farm-to-table restaurant) for one night during the stay;

- Private tour of the property and land;

- Welcome gifts upon arrival;

- Full access to all amenities, including the forest spa (wood-fired hot tubs, sauna, cold plunges, and showers).

Approximate Retail Value (ARV): $7,450.


6. Prize Conditions.

Weather and Seasonal Availability: The helicopter charter is subject to weather conditions and seasonal operation. If the helicopter portion cannot be provided or if the winner opts out, the Sponsor may offer a longer stay or equivalent alternate experience of equal or greater value at its sole discretion.

No Cash Alternative: The prize has no cash value and may not be transferred, sold, or redeemed for cash.

Scheduling: The winner must book and complete their stay within 12 months of prize notification, subject to availability.

Service Outages: Sponsor is not liable for any cancellations, delays, or service interruptions caused by weather, natural events, equipment malfunction, or other factors beyond Sponsor’s reasonable control.

Filming and Publicity: The winner and guests acknowledge that elements of the experience (including the helicopter portion and other trip moments) may be photographed or filmed by Sponsor for promotional purposes. By participating, they grant Sponsor the right to use their name, likeness, and image in any media without additional compensation.



7. Winner Selection and Notification.
One (1) potential winner will be randomly selected from all eligible entries received during the Promotion Period. The drawing will occur within [3–5] days after the Promotion ends. The potential winner will be notified by Instagram direct message or email (using the contact information provided).

- Canadian winners only must correctly answer, without assistance, a mathematical skill-testing question administered by the Sponsor to be declared the official winner.

- If a potential winner fails to respond within 48 hours, declines the prize, fails to meet eligibility requirements, or (if Canadian) fails to correctly answer the skill-testing question, the prize may be forfeited and awarded to an alternate entrant at Sponsor’s discretion.



8. Odds of Winning.
Odds depend on the total number of eligible entries received during the Promotion Period.


9. Limitation of Liability.
By entering, participants release and hold harmless the Sponsor, Meta Platforms Inc., Facebook, Instagram, and each of their respective subsidiaries, affiliates, agents, and representatives from any and all liability for injuries, losses, or damages of any kind arising from or in connection with participation or acceptance or use of the prize, including but not limited to delays, weather impacts, travel cancellations, or other circumstances beyond Sponsor’s control.


10. General Conditions.
Sponsor reserves the right to cancel, suspend, or modify this Promotion if fraud, technical failures, or any other factor impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. Any attempt to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws. All decisions of Sponsor are final and binding.


11. Privacy.
Personal information collected from entrants will be used solely for administering this Promotion and in accordance with the Sponsor’s Privacy Policy. Entrants may consent to receive marketing communications from the Sponsor and may unsubscribe at any time. All data will be handled in compliance with applicable privacy laws, including CASL (Canada) and CAN-SPAM (U.S.).


12. Governing Law.
Except where prohibited, this Promotion and any disputes arising under it shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict-of-law principles.


13. Winner List.
